By accessing, browsing, or using this Site and/or our facilities, services, memberships, or programs, you agree to comply with and be bound by the following Terms & Conditions and our Privacy Policy, which together constitute a legally binding agreement between you and Stark Fitness Kochi.

If you do not agree with these Terms & Conditions, you must discontinue use of this Site immediately.

 

1. MODIFICATION OF TERMS

Stark Fitness Kochi reserves the right to modify, update, or amend these Terms & Conditions at any time without prior notice. Changes will be effective immediately upon posting on the Site. Continued use of the Site or gym facilities constitutes acceptance of the revised terms.

 

2. ACCESS AND USE OF WEBSITE

All content available on this Site, including text, images, logos, graphics, videos, and design elements, is protected under applicable copyright and trademark laws.

  • Content may be viewed or downloaded solely for personal, non-commercial use
  • Reproduction, duplication, modification, distribution, transmission, or publication of any material without prior written consent is strictly prohibited

4. MEMBERSHIP TERMS

  • Memberships are non-transferable and non-assignable
  • Membership access is granted only to the registered individual
  • Sharing of membership credentials or allowing third-party usage will result in immediate termination without refund
  • Stark Fitness reserves the right to refuse admission or terminate membership at its sole discretion

5. PAYMENTS, OFFERS & REFUNDS

  • Fees once paid are non-refundable under any circumstances
  • Memberships purchased under promotional offers or discounted rates are non-refundable and non-transferable
  • Stark Fitness reserves the right to revise pricing, services, or facilities without prior notice
  • Membership activation is subject to full payment clearance

6. HEALTH & SAFETY DISCLAIMER

All members and guests acknowledge that participation in physical exercise involves inherent risks.

  • Members use gym equipment and facilities at their own risk
  • Stark Fitness is not responsible for injuries arising from improper use of equipment, unsupervised training, or non-adherence to instructions
  • Members are advised to undergo fitness assessments before commencing workouts
  • Stark Fitness is not liable for injuries, illnesses, or health conditions arising during or after workouts

7. WAIVER & RELEASE OF LIABILITY

By using the facilities of Stark Fitness Kochi, you agree to fully waive, release, and discharge Stark Fitness Kochi, its owners, directors, employees, trainers, and agents from any and all claims, damages, injuries, losses, or liabilities arising from:

  • Use of gym equipment
  • Participation in workouts, classes, or training programs
  • Accidents, slips, falls, or equipment malfunction
  • Theft or loss of personal belongings

This waiver shall be valid to the fullest extent permitted under Indian law.

 

8. CLUB RULES & CONDUCT

Members must adhere to all posted rules and gym etiquette, including but not limited to:

  • Proper workout attire and footwear are mandatory
  • No photography or videography without prior permission
  • No external personal trainers permitted
  • Re-rack weights after use
  • Maintain hygiene and cleanliness
  • Profanity, harassment, or disruptive behavior will not be tolerated

Violation of rules may result in suspension or termination of membership without refund.

 

9. CHILDREN & GUEST POLICY

  • Individuals under the age of 13 are not permitted in the gym unless part of a supervised program
  • Guests must register at reception and comply with all gym rules
  • Members are responsible for their guests at all times

10. THIRD-PARTY LINKS & SERVICES

The Site may contain links to third-party websites or services. Stark Fitness Kochi does not control or endorse such content and is not responsible for third-party practices, services, or policies.

 

11. TERMINATION

Stark Fitness Kochi reserves the right to immediately terminate access to the Site or gym facilities if a member breaches these Terms, violates gym rules, or engages in conduct deemed inappropriate or unsafe.

 

12. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable.

 

13. GOVERNING LAW & JURISDICTION

These Terms & Conditions shall be governed by and construed in accordance with the laws of India, with exclusive jurisdiction vested in the courts of Kochi, Kerala.
